Please read these Terms of Service ("Terms") carefully before using AAP - Auto Appraisals Perfected ("Service," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using our vehicle appraisal services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Service Description

AAP provides vehicle appraisal services including:

  • Vehicle Appraisals: Professional assessments of vehicle value based on information and documentation you provide
  • Document Processing: AI-assisted extraction of vehicle information from uploaded documents (titles, registrations, CARFAX reports, etc.)
  • Appointment Scheduling: Online booking system for appraisal appointments with licensed appraisers
  • Support Services: Chat-based support and ticketing system for customer assistance
  • Report Generation: Formal appraisal reports documenting the assessed value and vehicle condition

3. Account Registration and Security

3.1 Account Creation

To use our Service, you must create an account by providing:

  • A valid email address
  • Your full name
  • A secure password
  • Phone number (optional, but required for SMS notifications)

You may also register using Google or Twitter OAuth authentication.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password and account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your contact information remains accurate and up-to-date

We strongly recommend enabling two-factor authentication (2FA) for enhanced account security. We offer 2FA via email, SMS, or authenticator apps.

4. User Responsibilities and Conduct

4.1 Accurate Information

You agree to provide accurate, complete, and truthful information about:

  • Your identity and contact information
  • Vehicle details including VIN, mileage, condition, and history
  • Any known defects, damage, modifications, or issues affecting the vehicle
  • Ownership status and title status of the vehicle

Important: Providing false or misleading information may result in inaccurate appraisals, account suspension, and potential legal consequences. We reserve the right to reject appraisals based on suspected misrepresentation.

4.2 Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Submit fraudulent documents or falsified vehicle information
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems (bots, scrapers) to access the Service
  • Upload malicious code, viruses, or harmful content
  • Harass, threaten, or abuse our staff, appraisers, or other users

5. Appraisal Process and Deliverables

5.1 Appraisal Workflow

The appraisal process follows these stages:

  1. Draft: Initial appraisal request created
  2. Pending: Location/address set, awaiting payment
  3. In Review: Payment received, appraiser actively reviewing
  4. Completed: Appraisal finished, report generated and delivered

Appraisals in "Draft" or "Pending" status may be deleted by the customer. Once payment is received, appraisals cannot be deleted but may be subject to our refund policy.

5.2 Appraisal Reports

Upon completion, you will receive a formal appraisal report. This report represents the appraiser's professional opinion of value based on the information provided, current market conditions, and comparable sales data at the time of appraisal.

5.3 Nature of Appraisals

Important Disclaimer: Vehicle appraisals are professional opinions of value, not guarantees. The appraised value:

  • Is based on information available at the time of appraisal
  • May differ from actual sale prices achieved
  • Is subject to market fluctuations and conditions
  • Relies on the accuracy of information you provide
  • May not reflect undisclosed defects, damage, or history

6. Payment Terms

6.1 Pricing and Payment

Payment is required before your appraisal enters the review stage. We accept the following payment methods:

  • Credit and debit cards (Visa, Mastercard, American Express, Discover)
  • ACH bank transfers
  • Google Pay
  • Apple Pay
  • PayPal
  • Account balance (if applicable)

All prices are in US dollars. Applicable taxes may be added based on your location.

6.2 Payment Processing

Payments are processed securely through Stripe and PayPal. We do not store complete credit card numbers on our servers. By providing payment information, you authorize us to charge the specified amount.

ACH Payments: Bank transfers may take 3-5 business days to process. Your appraisal will move to "In Review" status once the payment is initiated, but will revert to "Pending" if the transfer fails.

6.3 Saved Payment Methods

You may save payment methods to your account for future use. You can manage and remove saved payment methods at any time through your account settings.

7. Appointments and Scheduling

7.1 Booking Appointments

When booking an appointment with an appraiser:

  • Selected time slots are held for 30 minutes pending payment
  • Unpaid appointments expire automatically and the slot becomes available again
  • Confirmed appointments appear on your dashboard and calendar

7.2 Cancellations

You may cancel a confirmed appointment through your account. Cancellation policies and any applicable refunds depend on the timing of cancellation and specific service terms.

8. Uploaded Content and Documents

8.1 Document Uploads

You may upload various documents to support your appraisal, including:

  • Vehicle photos (JPEG, PNG)
  • Documents (PDF, Word, Excel, text files)
  • Audio recordings (MP3, WAV, M4A)

Maximum file size: 50 MB per file. By uploading content, you represent that you have the right to share such content and that it does not violate any third-party rights.

8.2 AI Processing

Uploaded documents may be processed using AI technology to extract vehicle information automatically. This data extraction is intended to assist in completing your appraisal and is subject to review by appraisers.

9. Intellectual Property

9.1 Our Content

The Service, including its design, features, content, and software, is owned by AAP and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9.2 Your Content

You retain ownership of documents and images you upload. By uploading content, you grant us a license to use, store, and process that content for the purpose of providing our services.

9.3 Appraisal Reports

Completed appraisal reports are provided for your personal use. You may share reports with third parties (lenders, insurance companies, etc.) as needed. You may not alter, forge, or misrepresent appraisal reports.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF APPRAISALS
  • WARRANTIES REGARDING THIRD-PARTY INTEGRATIONS OR SERVICES

Appraisals represent professional opinions based on available information and are not guarantees of value.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AAP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND APPRAISERS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Decisions made based on appraisal values
  • Differences between appraised value and actual sale price
  • Errors resulting from inaccurate information provided by users
  • Service interruptions or technical failures

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid for the specific appraisal giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless AAP, its officers, directors, employees, agents, and appraisers from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • False or misleading information you provide
  • Content you upload to the Service

13. Termination

13.1 Termination by You

You may close your account at any time by contacting support. Account closure does not entitle you to refunds for completed appraisals or unused account balance.

13.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms or our Privacy Policy
  • Engage in fraudulent or illegal activity
  • Provide false information
  • Abuse or harass our staff or appraisers
  • Attempt to circumvent security measures

13.3 Effect of Termination

Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to conflict of law principles.

14.2 Informal Resolution

Before filing any formal dispute, you agree to contact us first to attempt to resolve the matter informally through our support channels.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AAP regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
